Madison Files Lawsuit to Settle Volunteer Firefighter's Estate

The Borough of Madison has filed a lawsuit against the executor of the estate for a volunteer firefighter who left $200,000 to the municipality before he died in 2011.

Peter Esposito, who never married, prepared a final will just weeks before he died of cancer that left the sizable gift to the borough and $1 million to friends, relatives and St. Vincent's Church, according to the Daily Record.

However, the estate still hasn't been dispersed to the beneficiaries, prompting borough officials to file the suit against John Benensky, of Madison, the executor of the estate, the Daily Record reported.

State Superior Court Assignment Judge Thomas Weisenbeck ordered Benensky during a brief hearing on Thursday to produce a formal accounting of the estate by May 16. Benensky, who did not attend the hearing, could be removed as executor if he doesn't comply, the Daily Record reported.
